11. Limitations of Liability

BY ENROLLING IN, ACTIVATING, USING OR PAYING FOR THE SERVICES, YOU AGREE THAT YOU HAVE READ THIS AGREEMENT AND UNDERSTAND THE LIMITATIONS OF 808NetFone DESCRIBED HEREIN.

Wavecom Solutions'S LIABILITY TO YOU ON ACCOUNT OF ANY ACT OR OMISSION OF Wavecom Solutions RELATED TO THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO ACTS OR OMISSIONS RELATED TO 911 DIALING, SHALL BE LIMITED TO ACTUAL DAMAGE TO REAL OR TANGIBLE PERSONAL PROPERTY, OR BODILY INJURY OR DEATH PROXIMATELY CAUSED BY Wavecom Solutions'S INTENTIONAL MISCONDUCT OR RECKLESSNESS, PROVIDED HOWEVER THAT DAMAGES PAYABLE BY Wavecom Solutions SHALL IN NO EVENT EXCEED TWELVE (12) TIMES YOUR MONTHLY SERVICE FEE FOR THE SERVICE. EXCEPT FOR DAMAGES THAT ARE THE DIRECT RESULT OF Wavecom Solutions'S WILLFUL OR INTENTIONAL MISCONDUCT, YOU WILL NOT BE ENTITLED TO ANY OTHER DAMAGES, INCLUDING INDIRECT OR CONSEQUENTIAL DAMAGES, REGARDLESS OF THE FORM OF ACTION. Wavecom Solutions AND OUR EMPLOYEES, AGENTS, CONTRACTORS AND REPRESENTATIVES WILL HAVE NO LIABILITY WHATSOEVER FOR ANY DAMAGES OR MODIFICATIONS TO, OR LOSS OR DESTRUCTION OF ANY OF YOUR SOFTWARE, FILES, DATA OR PERIPHERALS.
